Since Hrvol and Richter were a full-service operation—manufacturing evidence and trying the case—they argue that they should be immune from a lawsuit. They say that the rights of Ghee and Harrington were violated when they were convicted based on the false evidence, not when the evidence was actually manufactured. Under that interpretation, Hrvol and Richter were acting as prosectors when the civil rights violations occurred, so they have absolute immunity.
Isn't that just disgusting?
Not only should the exonerated be able to sue the prosecutor, the Prosecutor and every member of his staff, the police, and the judge, that could have known the evidence was manufactured should each, every one of them serve the same time as the exonerated individual. This is after he is awarded ALL of their collective assets in full, and they are disbarred, forbidden from ever doing anything other than stamping license plates in jail or shoveling horse shit in a farm outside of Des Moine. Assuming they manage to survive the 25 year sentence that their criminality condemned them to. I'm not sure a prosecutor will live that long in prison, but he deserves every ass rape, every shiving, and every broken tooth he gets for putting an innocent man into jail by lying, manufacturing evidence, and being the worst thing in the world: a legalized monster.
But maybe that's just my emotional, knee jerk reaction talking.
